User Agreement

Also referred to as our Terms of Service. Effective [Effective date — e.g. "August 1, 2026"].

This User Agreement (the “Terms”) is a binding agreement between you and [Trips IQ legal entity — e.g. "Trips IQ, LLC"] (“Trips IQ,” “we,” “us,” or “our”), the provider of Trips IQ — the website at tripsiq.com, the Trips IQ mobile applications, and related services (together, the “Service”). Please read them carefully. By creating an account, or by accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Who may use Trips IQ

You must be at least 18 years old (or the minimum age of digital consent in your country, if higher) to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms for it. You are responsible for complying with all laws that apply to your use of the Service.

2. Your account

Some features require an account. You agree to provide accurate information and to keep it up to date. You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly through the Contact page if you suspect any unauthorized use. We are not liable for losses caused by unauthorized use of your account where you failed to keep your credentials secure.

3. What Trips IQ does

Trips IQ helps you plan and organize travel. Depending on your plan, the Service lets you:

  • create trips and build itineraries (flights, hotels, transportation, events, and more);
  • import booking confirmations by forwarding them to a personal email address we assign you;
  • keep a reusable trip‑planning checklist and per‑trip to‑dos;
  • store travel documents such as passport details;
  • view destination information such as travel advisories, emergency contacts, embassy and health references, and suggested things to do; and
  • reach us through in‑app support.

We may add, change, or remove features at any time. Some features are offered only on paid plans, and availability may vary by region and device.

4. Subscriptions, Premium, and payments

The Service offers a free tier with usage limits and a paid “Premium” tier that removes limits and unlocks additional features. Where paid subscriptions are offered:

  • prices, features, and limits are those shown at the time you subscribe, and may change on a going‑forward basis;
  • subscriptions renew automatically for the period you selected unless you cancel before the renewal date;
  • you authorize us and our payment processor to charge your payment method for the fees and applicable taxes;
  • you may cancel at any time, and cancellation takes effect at the end of the current billing period; and
  • except where required by law, fees are non‑refundable and partial periods are not prorated.

Payment processing is handled by a third‑party provider and is subject to that provider’s terms; we do not store full card numbers.

5. Your content and acceptable use

“Your Content” means the information you add to the Service — trip details, notes, uploaded files and documents, and similar. You retain ownership of Your Content. You grant us a limited license to host, store, process, and display it solely to operate and provide the Service to you.

You agree not to:

  • use the Service for any unlawful purpose or in violation of these Terms;
  • upload content that infringes others’ rights or that you do not have the right to store;
  • attempt to access accounts, data, or systems that are not yours;
  • probe, scan, overload, or disrupt the Service, or bypass its security or rate limits;
  • reverse engineer or copy the Service except as permitted by law; or
  • use the Service to send spam or to abuse the email‑import feature.

You are responsible for Your Content and for keeping your own backups of anything important.

6. Travel documents and sensitive information

The Service lets you store sensitive information such as passport details. We apply reasonable technical measures to protect that information (for example, encrypting document numbers at rest). No method of storage or transmission is completely secure, however, and we cannot guarantee absolute security. You choose what to store, and you do so at your own discretion and risk. Do not store information you are not comfortable providing.

7. Third‑party information and services

The Service incorporates information and tools from third parties — for example, place and “things to do” data from mapping providers, travel advisories from government sources, health references from public‑health authorities, and email delivery and payment providers. That information is provided by those third parties, may be incomplete, outdated, or inaccurate, and is subject to their own terms. We do not control and are not responsible for third‑party content or services.

8. Travel, safety, and health information is not professional advice

Any advisories, emergency numbers, embassy references, health and vaccination notes, safety details, and suggestions the Service surfaces are provided for general informational convenience only. They are not travel, legal, medical, financial, or professional advice, may change without notice, and may not be accurate for your situation. Always verify critical information with official and authoritative sources — such as the relevant government, embassy, airline, or a qualified professional — before making decisions. You are solely responsible for your travel decisions.

9. Intellectual property

The Service, including its software, design, text, graphics, and the Trips IQ name and logos, is owned by us or our licensors and is protected by intellectual‑property laws. We grant you a limited, personal, non‑exclusive, non‑transferable, revocable license to use the Service in accordance with these Terms. We reserve all rights not expressly granted.

10. Privacy

Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of information as described there.

11. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non‑infringement. We do not warrant that the Service will be uninterrupted, error‑free, or secure, or that any information it provides is accurate or complete. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

12. Limitation of liability

To the fullest extent permitted by law, [Trips IQ legal entity — e.g. "Trips IQ, LLC"] and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service. To the fullest extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or US$50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless [Trips IQ legal entity — e.g. "Trips IQ, LLC"] and its owners, employees, and suppliers from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your Content, your use of the Service, or your violation of these Terms or of any law or third‑party right.

14. Suspension and termination

You may stop using the Service at any time and may delete your account. We may suspend or terminate your access if you violate these Terms, if we reasonably believe it is necessary to protect the Service or other users, or if we discontinue the Service. On termination, your right to use the Service ends; sections that by their nature should survive (such as ownership, disclaimers, limitation of liability, and indemnification) will survive.

15. Changes to the Service or these Terms

We may modify the Service and these Terms from time to time. When we make material changes to the Terms, we will update the effective date above and, where appropriate, provide notice. Changes are effective when posted. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

16. Arbitration, class action waiver, and governing law

Please read this section carefully. It affects how disputes between you and us are resolved and, in most cases, requires them to be settled by binding arbitration on an individual basis rather than in court.

Mandatory arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The place of arbitration shall be Phoenix, Arizona. Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

Class action waiver. YOU AND TRIPS IQ AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.

Attorneys’ fees and costs. In the event of any arbitration or legal action taken to enforce or interpret these Terms, the prevailing party shall be entitled to recover its reasonable attorneys’ fees, expert witness fees, and all costs of collection and litigation (including arbitration fees), in addition to any other relief to which that party may be entitled.

Governing law and venue. These Terms are governed by the laws of the State of Arizona, without regard to its conflict‑of‑laws principles. To the extent any claim is permitted to be brought in court (such as in small‑claims court or a request for injunctive relief), you irrevocably consent to the exclusive personal jurisdiction and venue of the state and federal courts located in Maricopa County, Arizona.

17. General

These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Nothing in these Terms creates any agency, partnership, or employment relationship between you and us.
